We, Hidee Technology Ltd (registration number HE 490226), a private company limited by shares incorporated in the Republic of Cyprus, having our registered office at Dimitri Charalampous, 13, Office 4B, Agios Antonis, 3020 Limassol, Cyprus ("Hidee", "we", "us" or "our"), license you to use:

  • the Hidee mobile application software, and any updates or supplements to it (the App); and

  • the services you access through the App, including the on-device face-masking and editing tools, the AR Lenses, and the subscription features (the Services), as permitted in these terms.

Hidee is an iOS application that lets parents and guardians automatically mask children's faces in photos and videos before that content is shared. All face detection and masking is performed entirely on your device. Your photos and videos are never transmitted to our servers. To place a mask and keep it on the face you have selected, the App also measures each face it detects, on your device. Those measurements are used only while your file is being processed, are not stored, and are not transmitted to us. Depending on where you live they may be treated as biometric data; this is explained in our Privacy Policy.

The only data we hold on our servers is your account record (an internal user identifier and the email address Apple returns when you sign in), your subscription status and, if you are on the free plan, a count of the exports you have used. That data is stored in the European Union (Frankfurt, Germany). Photos, videos and face data are never stored on our servers. Section 10 explains this in more detail.

The following also form part of these terms:

  • Apple App Store terms. Your download and use of the App are also governed by Apple's standard licensed application end-user licence agreement and the Apple Media Services Terms and Conditions. Where those Apple terms conflict with these terms in respect of your use of the App via the App Store, the Apple terms will apply to that extent.

  • Snap Camera Kit terms. The AR Lenses used to mask faces are powered by Snap's Camera Kit. The first time you use a Lens, you will be asked to accept Snap Inc.'s terms. Your use of the Lenses is subject to Snap's Terms of Service (https://snap.com/terms/camera-kit) and Snap's Privacy Policy (https://snap.com/privacy/privacy-policy). While the Lenses are in use, the Camera Kit software reports usage and performance data about the App to Snap, and that reporting cannot be switched off. We do not send your photos or videos, or the face measurements described in section 1, to Snap.

The following also form part of these terms:

The ways in which you can use the App may also be controlled by Apple's App Store rules and policies. Apple's rules and policies will apply instead of these terms where there is any conflict.

This App is for Apple devices and requires an iPhone or iPad running iOS 16.0 or later. Some features (including certain AR Lenses) may require a device that supports the relevant Apple frameworks.

In return for your agreeing to comply with these terms, you may:

  • download or stream a copy of the App onto an Apple device that you own or control, and view, use and display the App and the Services on that device for your personal, non-commercial purposes only;

  • share the App with members of your family in accordance with Apple's Family Sharing rules, where enabled; and

  • receive and use any free supplementary software code, update or supplement of the App that we may provide to you.

8. You must be 18 to accept these terms

You must be 18 or over to accept these terms, to download the App and to take out a subscription. The App is designed for use by parents and guardians (adults). It is not directed at, or intended for use by, children.

You are responsible for ensuring you have the right to edit and share any photos or videos you use in the App, including the right to feature any children shown in them.

9. Subscriptions, payment and cancellation

Hidee is offered on an auto-renewing subscription basis (monthly or yearly). There are no separate one-time purchases.

Free plan and export allowance. The App can be used without a subscription, with a limited number of exports in each allowance window. We keep a count of the exports you have used in the current window so that the allowance can be applied. Once the allowance has been used, further exports require an active subscription.

Payment through Apple. All subscriptions are purchased and processed through Apple In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase. We do not receive, see or store your payment card details, billing address or payment history; these are handled solely by Apple.

Auto-renewal. Your subscription automatically renews for successive periods unless you cancel it at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the end of the current period, at the price for the applicable plan.

Managing and cancelling. You can manage or cancel your subscription at any time in the App Store account settings on your device. There is no separate cancellation process within the App. Cancellation takes effect at the end of the current paid period; you retain access to paid features until then.

Refunds. Refunds are requested from, and decided by, Apple under the Apple Media Services Terms and Conditions. We receive your refund status from Apple so that access to paid features can be adjusted accordingly.

Prices. Prices are shown in the App before you purchase and are set per region. Where required (for example in the EU), prices are displayed inclusive of applicable taxes such as VAT. Apple handles taxes and currency conversion.

10. On-device, local-first storage

Hidee is built to be private by design. Your projects, drafts and the media you edit are stored only on your device, not on our servers. The face measurements described in section 1 are not stored at all: they exist only while your file is being processed and are destroyed when it finishes. No photos, videos or face data are stored on our servers at any time. This has some important consequences that you accept by using the App:

  • your projects will not automatically sync between your devices;

  • if you delete the App, or your device is lost, reset or damaged, your projects will not be restored and we cannot recover them for you; and

  • you remain in control of your original photos and videos, which stay in your device's own photo library.

We recommend that you keep your own back-ups of any originals and exported files that are important to you. We may add optional cloud sync or back-up features in the future; if we do, we will update these terms and our Privacy Policy accordingly.

What we do hold on our servers. So that the App can work, we hold a small amount of data on our backend: your account record (an internal user identifier and the email address Apple returns, which may be an Apple private-relay address), your subscription status, and, on the free plan, your export count. Our backend is provided by Supabase running on Amazon Web Services infrastructure, and the database, authentication data, automated backups and file storage are all located in a single European Union region: Frankfurt, Germany. Our Privacy Policy explains how this data is used and how long it is kept.

Deleting your account. You can delete your account at any time using the delete-account button in the App. This removes your account record together with your subscription record, your export counter and the Apple token linked to your account. Deleting your account does not cancel your Apple subscription — you must cancel it separately in your App Store account settings, as described in section 9 — and it does not delete the projects and media held on your device, which remain under your control.

11. Changes to these terms

We may need to change these terms to reflect changes in law or best practice, or to deal with new features we introduce.

We will give you reasonable notice of any material change by push or in-app notification, or by email. If you do not accept the notified changes, you may stop using the App and the Services and cancel any subscription as described above.

12. Updates to the App and changes to the Services

From time to time we may update the App and change the Services to improve performance, add functionality, reflect changes to the operating system, or address security issues. If you choose not to install updates, or if you opt out of automatic updates, you may not be able to continue using the App and the Services.

13. If someone else owns the device you are using

If you download or use the App on a device you do not own, you must have the owner's permission to do so. You are responsible for complying with these terms whether or not you own the device.

14. We are not responsible for other apps or websites you link to

The App lets you export edited media and share it through Apple's native share sheet to other apps (such as social media or messaging apps). Those apps and any websites they link to are not provided or controlled by us, and we are not responsible for them or their privacy practices. Once you share content to another app, that app's own terms and privacy policy apply. You should make your own judgement before sharing content.

15. Licence restrictions

You agree that you will:

  • not rent, lease, sub-license, loan, provide or otherwise make available the App or the Services in any form, in whole or in part, to any person without our prior written consent;

  • not copy the App or the Services, except as part of the normal use of the App or where necessary for back-up or operational security;

  • not translate, merge, adapt, vary, alter or modify the whole or any part of the App or the Services, nor permit them to be combined with, or incorporated into, other programs, except as necessary to use them as permitted in these terms;

  • not disassemble, de-compile, reverse engineer or create derivative works based on any part of the App or the Services, nor attempt to do so, except to the extent that such restriction is prohibited by applicable law; and

  • comply with all applicable technology-control and export laws that apply to the technology used by the App or the Services.

16. Acceptable-use restrictions

You must not:

  • use the App or any Service in any unlawful manner, for any unlawful purpose, or in any way inconsistent with these terms, or act fraudulently or maliciously (for example, by inserting malicious code or harmful data into the App or any operating system);

  • use the App or any Service to create, edit, mask or share any content that is unlawful, or that exploits, endangers or harms any child, or that infringes the rights of, or invades the privacy of, any person;

  • infringe our intellectual property rights or those of any third party in relation to your use of the App or any Service;

  • transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App or any Service; or

  • use the App or any Service in a way that could damage, disable, overburden, impair or compromise our systems or security, or interfere with other users.

17. Intellectual property rights

All intellectual property rights in the App and the Services throughout the world belong to us (or our licensors, including Snap Inc. in respect of Camera Kit and the AR Lenses), and the rights in the App and the Services are licensed (not sold) to you. You have no intellectual property rights in, or to, the App or the Services other than the right to use them in accordance with these terms. You retain all rights in the photos and videos you create or edit using the App.

18. Our responsibility for loss or damage suffered by you

We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or of our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. Nothing in these terms affects your mandatory legal rights as a consumer.

We are not liable for business losses. The App is for domestic and private use. If you use the App for any commercial or business purpose, we will have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

Please back up your content. Because your projects and media are stored only on your device, we recommend you back up any content and originals that are important to you. We are not responsible for loss of projects that results from deleting the App, or from loss, reset or damage to your device.

We are not responsible for events outside our control. If our provision of the Services is delayed by an event outside our reasonable control, we will take steps to minimise the effect of the delay, and we will not be liable for delays caused by the event.

19. We may end your rights to use the App and the Services if you break these terms

We may end your rights to use the App and the Services at any time by contacting you if you have broken these terms in a serious way. If what you have done can be put right, we will give you a reasonable opportunity to do so. If we end your rights:

  • you must stop all activities authorised by these terms, including your use of the App and the Services;

  • you must delete or remove the App from all devices in your possession; and

  • we may cease providing you with access to the Services, including the AR Lenses and any subscription features.

20. We may transfer this agreement to someone else

We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens, and we will ensure that the transfer does not affect your rights under these terms.

21. You need our consent to transfer your rights to someone else

You may only transfer your rights or obligations under these terms to another person if we agree in writing. If you sell or give away any device on which the App is installed, you must remove the App from it.

22. No rights for third parties

These terms are between you and us. No other person has any right to enforce any of these terms.

23. If a court finds part of these terms unlawful, the rest will continue in force

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them is unlawful, the remaining paragraphs will remain in full force and effect.

24. Even if we delay in enforcing these terms, we can still enforce them later

If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking these terms, that will not mean that you do not have to do those things, and it will not prevent us taking steps against you at a later date.

25. Governing law and jurisdiction

These terms, their subject matter and their formation are governed by the laws of the Republic of Cyprus. You and we agree that the courts of the Republic of Cyprus have jurisdiction to settle any dispute or claim arising out of or in connection with these terms.

If you are a consumer resident in the European Union or the EEA, you benefit from any mandatory provisions of the law of your country of residence. Nothing in these terms, including the choice of Cyprus law, affects your rights as a consumer to rely on those mandatory provisions, and you may also be able to bring proceedings in the courts of your country of residence.

26. Complaints and dispute resolution

If you have a complaint, please contact us first at info@hidee.app so that we have the opportunity to resolve it. If you are a consumer resident in the EU/EEA and we cannot resolve your complaint, you may be entitled to refer the dispute to an alternative dispute resolution body or to your local consumer-protection authority. Using alternative dispute resolution is voluntary and does not affect your right to bring court proceedings.
